The following Purchase Terms and Conditions are designed to ensure your satisfaction and understanding of the purchase process on Ticketscene.ca. These Purchase Terms and Conditions are subject to, and incorporate by this reference, the Terms of Service. Each ticket that you purchase is a license to attend a particular event, and is subject to the additional terms set forth on that ticket.
Currency
All ticket prices for events under Ticketscene.ca that occur in Canada are in CAD Dollars and all ticket prices for events under Ticketscene.com that occur in the United States are in U.S. Dollars.
Payment Methods
Ticketscene.ca accepts several methods of payment. These include Visa, Visa/Debit, and MasterCard. Charges to your credit card will appear as "Ticketscene Kitchener"
Who You Are Buying From
Ticketscene acts as the agent to those who are promoting or otherwise providing the events for which you purchase tickets, such as venues, festival organizers, leagues, artist representatives, charities, and promoters ("Event Providers"). If you purchase a ticket through Ticketscene, you will either be purchasing that ticket from: the Event Provider.
Pricing and Availability
Tickets for popular events may sell out quickly. Occasionally, additional tickets may be available prior to the event. However, Ticketscene does not control this inventory or its availability. In some cases, Ticketscene or other distribution channels may receive additional, subsequent allocations of tickets for distribution, which may arguably be of similar or higher desirability than those sold on Ticketscene, or may be offered for sale at lower prices than prices charged on Ticketscene.
Order Confirmation
If you do not receive a confirmation number (in the form of an email) after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with Ticketscene Customer Service whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. Ticketscene will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation. Refunds and Exchanges
All tickets and items purchased through Ticketscene are final sale and are non-refundable except in the case of cancelled, postponed, or re-scheduled events subject to the contitions below.
Before purchasing tickets, carefully review your event and seat choices if available. Please note that most events on Ticketscene are General Admission which means no assigned seating. Policies set forth by our clients, including venues, and theatres, generally prohibit Ticketscene from issuing exchanges or refunds after a ticket has been purchased or lost, stolen, damaged or destroyed tickets. You agree that you will not attempt to evade, avoid, or circumvent those prohibitions in any manner with regard to tickets you purchased. Without limiting the generality of the foregoing, you will not contact Ticketscene to seek a refund or exchange from Ticketscene when Ticketscene is prohibited from providing one by its clients, and you will not dispute or otherwise seek a "chargeback" from the company whose credit card you used to purchase tickets from the Site. Should you do so, your tickets may be cancelled, and Ticketscene may, in its sole discretion, refuse to honour pending and future ticket purchases made from all credit card accounts or online accounts on which such chargebacks have been made, and may prohibit all persons in whose name the credit card accounts exist and any person who accesses any associated online account or credit card or who otherwise breaches this provision from using the Site.
If Ticketscene issues you a refund for a ticket whether the event is postponed or cancelled, it will issue a refund of the ticket's face value paid but not on the facility fee and/or service fee/ processing charge. Under no circumstances will any of the surcharge fees or amounts be refunded. If a refund is issued, it will be issued using the same method of payment that was used to purchase the tickets. If a credit card was used to make the refunded purchase, then only that actual credit card will receive the credit for the refund. Ticketscene will not be liable for travel or any other expenses that you or anyone else incurs in connection with a cancelled or postponed event.
Ticketscene typically only offers refunds and/or exchanges based on the promoter's or venue's instructions. Ticketscene is not obligated to issue a refund except to the extent that the promoter, venue, or event provider responsible for bringing you the event (1) instructs us to issue a refund, and (2) provides us with the funds necessary to issue refunds. In order to receive a refund or an exchange that may be offered, you will have to comply with the promoter's, team's or venue's instructions or deadlines, which, along with the decision about whether or not to issue a refund or an exchange, may be at the promoter's, team's or venue's discretion.
Event Protect®
Ticketscene is a Member of Event Protect, the industry standard in event cancellation insurance. Our Membership of Event Protect provides certainty of our ability in the case of a cancellation / postponement / abandonment / curtailment of an event covered under the Event Protect Scheme, to provide refunds directly to ticket holders in a fast and transparent way. Discount Codes or Promotional Offers
All discount codes or promotional offers must be entered at the time of purchase. Tickets may be offered at a discounted rate at any time after the original onsale date and we will not refund the difference between the purchase price and the sale price for any tickets that have already been issued.
Convenience Charges, Service, and Order Processing Fees
Tickets purchased on Ticketscene are subject to a per ticket service/order processing fee which is non-refundable, including events that are cancelled or postponed. All sales are final. In the event of a cancellation, Ticketscene will refund the face value of the ticket but not any service fees.
Cancelled and Postponed Events
Occasionally, events are cancelled, postponed or rescheduled by the promoter, or Event Providers. Should this occur, Ticketscene will attempt to contact you by email to inform you of refund or exchange procedures for that event. Typically, if the event is postponed, you will have up to 72 hours prior to the new event date to request a refund if the new scheduled event is not convenient for you. For exact instructions on any cancelled or postponed event, please check the event information online or contact us. If you purchase a ticket through Ticketscene and a refund is issued, then Ticketscene will most likely give you a refund by issuing a credit to the credit card that you used to purchase that ticket. Service fees are 100% not refundable and only the face value of the ticket will be refunded.
Distressed Event Definition
The ticket buyer agrees an event can become distressed and understands there are circumstances beyond the control of the Event Promoter that could arise that could impact the event prior to its conclusion. To further clarify, a distressed event is defined as: an event that that takes place and is being delivered as planned and advertised; where your ticket gained you entry into the venue or festival; where the event is running as scheduled, but due to any number of unforeseen circumstances, the event could not be completed.
Opening and Headlining Acts
Opening acts, guests, or support acts, may sometimes tour with headlining performers. Ticketscene is not always made aware of opening acts or the length of their performances. These opening acts are subject to change or cancellation at any time without notice. No refund will be owed if an opening act is changed or cancelled. If you attend an event that takes place but for whatever reason the headlining or co-headlining act does not perform or make an appearance and the event becomes distressed, meaning the majority of event took place as promised but for unforeseen circumstances and misfortune, the headliners and support acts chose not to fulfill their responsibilities, Ticketscene will not issue refunds unless authorized by the Event Promoter. It is the Event Promoter’s responsibility to outline the terms of their refund policy for the distressed event by providing Ticketscene with written direction as to whether or not ticket buyers are to be full refunded, partially refunded, or not refunded at all. In any case, the service fees paid to Ticketscene will NOT be refunded.
Festivals
Ticket buyers agree that when a ticket to a festival is purchased, the ticket buyer is buying a ticket to the entire festival, not a ticket to see a specific artist, performer, speaker, or attraction. Festivals have the right to alter their line up and activities prior or on the day of the festival. No refunds will be issued if the festival takes place and any part of it’s published line up, attractions, or artist line up including headliners do not perform.
Billing Information Verification
Orders are processed only after billing information and the CVV Security number has been verified. Occasionally, we receive incorrect credit card account information for a ticket order that will cause an order to be cancelled. There are also instances where your credit card will get declined even if your information and available credit are correct. In these cases, please contact your credit card issuing company before making another purchase attempt. In most cases, they will remove the security filter and allow your transaction to take place.
Delivery Options
Tickets purchased on Ticketscene are issued as eTickets that you print from home/work. Once you purchase a ticket successfully, Ticketscene will send you a confirmation email and provide a link to download and print the tickets. Tickets will not be mailed. Always bring your eTicket and a government ID to the door or gate in order to verify your purchase.
Pricing and Other Errors
If the amount you pay for a ticket is incorrect regardless of whether because of an error in a price posted on this website or otherwise communicated to you, or you are able to order a ticket before its scheduled on-sale or presale date or you are able to order a ticket that was not supposed to have been released for sale, then: Ticketscene will have the right to cancel that ticket (or the order for that ticket) and refund to you the amount that you paid. This will apply regardless of whether because of human error or a transactional malfunction of this website or other Ticketscene operated system.
Multiple Browser Windows
When ordering tickets online with Ticketscene, please ensure you are looking for tickets and placing an order using only one browser window. Looking up tickets using multiple browser windows could result in losing your tickets or timer expiration.
Limitation of Liability
You assume all risks incidental to the event for which a ticket is issued, whether before, during or after performance, and you waive any claims for personal injury or death against Ticketscene on behalf of yourself and any accompanying minor.
License; Ejection and Cancellation; No Redemption Value
Event Providers reserve the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct management deems disorderly, who uses vulgar or abusive language or who fails to comply with Event Provider rules. Breach of terms or rules will terminate your license to attend the event without refund. A ticket is a revocable license and admission may be refused upon refunding the ticket's face amount. A ticket is not redeemable for cash.
Recording, Transmission and Exhibition
You agree not to record or transmit, or aid in recording or transmitting, any description, account, picture, or reproduction of the event. You agree that the event for which you purchase tickets is a public event, that your appearance and actions inside and outside the venue where the event occurs are public in nature, and that you have no expectation of privacy with regard to your actions or conduct at the event. You grant permission to Ticketscene and the Event Provider(s) to utilize your name, image, likeness, acts, poses, plays, appearance, movements, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event (regardless of whether before, during or after play or performance) for any purpose, in any manner, in any medium or context now known or hereafter developed, without further authorization from, or compensation to, you or anyone acting on your behalf.
You Are Subject to Search
You and your belongings may be searched on entry to the event. You consent to such searches and waive any related claims that may arise. If you elect not to consent to such searches, you may be denied entry to the event without refund or other compensation. Under certain facility rules, certain items may not be brought into the premises, including without limitation, alcohol, drugs, controlled substances, cameras, recording devices, bundles and containers.
Unlawful Re-Sale of Tickets; Commercial Purposes
Unlawful resale of tickets (or attempted resale) is grounds for seizure and cancellation without compensation. A ticket shall not be used for advertising, promotions, contests or sweepstakes, unless formal written authorization is given by the Event Provider, provided that even if such consent is obtained, any use of Ticketscene's trademarks and other intellectual property is subject to Ticketscene's consent.
Event Newsletters and Email Lists
By signing up to Ticketscene and using this service to purchase event tickets, you will be automatically added to Ticketscene's monthly email newsletter that promotes upcoming events that may be of interest to you. In each newsletter, you will have the option to opt out and not receive any further communication from Ticketscene.
